- Workers’ compensation is the exclusive remedy against an employer for most on-the-job injuries, which means no recovery for pain and suffering from the employer. An injury must be reported to the employer within 30 days, and a petition for benefits filed within two years. A separate claim against a negligent third party — another driver, a property owner, an equipment manufacturer — is not barred by the exclusive remedy rule. Fla. Stat. §§ 440.11 and 440.185.
