The three things that change a claim most
Fault allocation differs by state
California and New York reduce a claim in proportion to your fault but never bar it. Florida and Texas bar recovery entirely above 50% fault, which means the same facts can be worth nothing in one state and substantial in another.
No-fault states add a threshold
In Florida and New York you generally cannot claim pain and suffering from the at-fault driver unless your injury clears a statutory threshold. A moderate soft-tissue injury often does not, which caps the claim near your PIP limit.
Available insurance often decides the outcome
A claim is only worth what is collectible. Florida does not require ordinary drivers to carry bodily injury liability coverage at all, so the driver who injured you may have none, and your own uninsured motorist coverage becomes the practical source of recovery.
