- Texas is the only state where private employers may decline to carry workers’ compensation. A subscribing employer gets the exclusive remedy defense, so no pain and suffering recovery. A non-subscriber can be sued directly in negligence and loses the contributory negligence, assumption of risk, and fellow servant defenses, which makes a non-subscriber claim substantially more valuable. An injury must be reported within 30 days and a claim filed within one year. Tex. Lab. Code §§ 406.033, 408.001, and 409.003.
